Action in the Nobles County District Court for personal injuries allegedly sustained by plaintiff Ross A. Anderson, and for consequential damages sustained by his father, plaintiff Gordon B. Anderson, as the result of an accident which occurred while said Ross Anderson was a passenger in an automobile owned by defendant Howard Luitjens and driven by defendant Wendy Jean Johnson which collided with one driven by defendant Thomas Edward Pettit. It was alleged that the former driver was illegally sold intoxicating liquor by defendant Charles J. Denker, d.b.a. Chuck's Tavern, and that that sale caused the accident. The court, Harvey A. Holtan, Judge, granted a motion by defendant Denker for dismissal of the complaint as to him, and separate appeals from said order were filed by plaintiffs, defendants Luitjens and Johnson, and defendant Pettit.
